Recently, the Federal Tax Authority (FTA) has announced that starting from Thursday, June 1, 2023, companies will be charged for requesting “private clarification. The FTA has clarified that the fees will be charged for submitting a request to seek additional information and clarification related to one or more taxes issued by the FTA. The clarification will be provided as a document stamped and signed by the FTA, exclusively for specific tax technical matters and a particular taxpayer.
The term “private clarification” refers to a formal request made by a taxpayer through a designated form available on the authority’s website. The request should include all relevant documents necessary for clarification. The governing body will impose the fee per the execution of Cabinet Decision No. 7 of 2023.
By a recent decision, the regulatory body has clarified that the Federal Tax Authority (FTA) can reimburse the expenses associated with a “private clarification” request to the requester when the requested clarification is not provided.
The consulting firm Crowe has stated that they charge a service fee of Dh1,500 for clarification requests related to a single tax and Dh2,250 for multiple taxes. They have clarified that the term ‘tax’ refers to the applicable taxes in the UAE, which include VAT, Excise Tax, and Corporate Tax. Crowe has also advised that due to the additional fees involved in requesting a ‘Private Clarification,’ it is advisable to submit the request before its effective date of June 1, 2023.
